AmCham’s Position Paper on cloud and AI in the draft SAFE Regulation

AmCham has prepared a position paper in which we addressed aspects of the Security Action For Europe (SAFE) regulation regarding the military application of cloud computing and artificial intelligence. SAFE aims to establish a new instrument for financing joint defense investments by European Union member states. In the current draft of SAFE, we find a number of technical provisions that may inadvertently undermine European defense capabilities and interoperability of NATO forces by restricting access to these key commercial technologies.
In our position paper, we primarily highlighted:
1) Blanket security clearance requirements on all personnel involved in handling classified data, which are contrary to current best practices of NATO countries
2) Artificial intelligence systems regulations that focus on swapping physical components rather than operational control, which is not in line with the functioning of modern military AI systems
3) Unclear criteria for classifying suppliers.
