Following the announcement of the second round of public consultations on the draft bill on artificial intelligence systems, AmCham has prepared a position paper on the new version of the bill. The bill aims to enable the application of the AI Act’s provisions in Poland, crucially important for US investors offering leading AI-based solutions. The Ministry of Digital Affairs has taken into account many of AmCham’s comments concerning the first version of the bill, but the updated version also requires significant revisions, in our view. In our position paper, we highlighted, among other issues:
1) Inadequate standards for protecting information obtained by the Commission,
2) Significant doubts about the Commission’s funding model,
3) The vagueness of the law’s material and geographic scope of application,
4) The inadequacy of some of the deadlines envisioned by the new version of the law.
