AmCham Poland, together with the Union of Entrepreneurs and Employers (ZPP) and the Lewiatan Confederation, has prepared an appeal regarding the work on the EU SEP regulation. It was issued in response to the posting of information about the planned withdrawal from the work on the draft regulation in the European Commission’s work plan.
In our position paper, we draw attention to the deep, structural problems associated with the current legal state of the essential patents standard. European courts are being used for questionable market practices by a narrow group of SEP patent holders who are taking advantage of the lack of transparency in licensing processes, harming innovation in the European economy and leading to negative effects on consumers, especially in markets based on communications standards and Internet of Things products. We urge policymakers of the Polish Presidency, Polish MEPs and the European Commission to continue work on the SEP Regulation to establish a viable, operational framework for fair, reasonable and non-discriminatory patent licensing.
