AmCham Meeting with Mr. Jan Nowak, the President of the Personal Data Protection Office

We are pleased to invite you to an on-line AmCham meeting with the President of the Personal Data Protection Office, Mr. Jan Nowak. The meeting will take place on Tuesday, November 10th, from 1:00 to 2:00 p.m., with AmCham Chairman Tony Housh leading the discussion.
Data protection refers to all business entities operating in Poland, which gather employee data, have client databases, or use data for advertising and marketing. This topic became even more important for businesses after the new EU General Data Protection Regulation (famous GDPR) came into force in May 2018, which uniformed the regulation of data throughout Europe, significantly changed privacy compliance in Europe, and forced all companies operating in the EU to adopt new data protection rules.
For American companies, data protection rules have become crucial since July 16, 2020, when the Court of Justice of the European Union passed its judgment regarding Schrems II. In short, the judgment invalidated the EU-U.S. Privacy Shield and clarified that the use of standard contractual clauses requires data controllers to conduct a case-by-case assessment of the level of data protection that these clauses are to provide. The judgment affects all European companies transferring data from the EU to the U.S. as this puts these entities in a world of legal uncertainty.
We would like to discuss with the President of the Personal Data Protection Office, Mr. Jan Nowak the judgment's impact on American companies operating in Poland, current possibilities of safe transfer of data to the U.S., and planned actions of the Personal Data Protection Office to support the development of new mechanisms allowing the transfer of data between the EU and the U.S.
