As a result of consultations with member companies, AmCham Poland has prepared a position paper on the Draft Bill on Artificial Intelligence Systems, which aims to make the provisions of the EU Artificial Intelligence Act applicable in Poland. Since The most important element of the draft is the establishment of a new regulatory body, the Artificial Intelligence Development and Security Commission, most of our comments focused on the proposed legal framework for the functioning of the Commission.
In particular, we highlighted in our position paper:
1) The need to clarify the personal scope of the Act, especially in the context of the operation of international groups,
2) The potential inconsistency of the envisaged powers of the Commission with the rules on the cross-border application of the AI Act,
3) Legal problems arising from the envisaged provisions on individual interpretations,
4) The need to take into account the specificities of the pharmaceutical industry in the legislation,
5) The proportionality and adequacy of the proposed competences of the Commission, in particular in terms of control and management of sensitive information.
