Independent contractors of employees? New powers of Labor Inspectorate promise to shift the paradigm!

On October 15, 2025, the AmCham HR Committee hosted Marcin Sanetra and Robert Stępień from PCS Paruch Chruściel Stępień Kanclerz, an AmCham member company, to discuss proposed changes granting the State Labor Inspectorate (Państwowa Inspekcja Pracy) the power to quickly reclassify B2B and some civil law contracts as employment agreements (if the circumstances of cooperation indicate features of an employment contract). The proposed changes would apply not only to the new B2B contracts, but also to those already in force, and employers would have just seven days to appeal such decisions.

To prepare for the upcoming legislation, businesses should conduct an internal pre-audit for reclassification risk, secure electronic documentation, and be ready to respond within the short appeal window. Concluding the meeting, our speakers and participants agreed that while the purpose of the proposed law is to increase the effectiveness of inspections and enhance the protection of workers, the lack of clear criteria raises concerns that the proposed regulations are too broad and may violate the freedom of contract.
