Another AmCham Tax & Financial Services Committee meeting took place on Thursday, November 7, 2024. Sabina Sampławska, Michał Niżnik, Mariusz Kułagowski, Andrzej Zyga, and Mariusz Głodek from our member firm KPMG gave a presentation entitled “WHT in Poland—challenges for international businesses,” in which they discussed the latest developments and ongoing work on Withholding Tax regulations.
The presentation focused on the regulations and practices of tax authorities regarding alternatives to the Pay and Refund mechanism. Particular attention was paid to the problems of companies operating in international capital groups in which funds are transferred outside the European Union, such as to the United States. Speakers also discussed the ongoing efforts of working groups at the Ministry of Finance, which are currently dealing with the basic issues related to WHT: beneficial owner, look-through approach and subject to tax.
