If your supplier, client, or competitor abuses its dominant position or is a member of a cartel, their actions may cause damage to your business. On the other hand, if your company is in the spotlight for its dominant position, others may feel they have incurred damage due to your actions. Since the implementation of the Damages Directive in Poland, it is easier to obtain compensation due to damage claims and, at the same time, leading companies are at a greater risk of civil liability for collusion. $43 billion every year is at stake for damages suffered through illegal collusion, according to EU statistics.
On June 14, AmCham organized a workshop on Private Enforcement Claims – a New Source of Income in which we helped identify potential claims against other market players and prepare defense strategies against private enforcement claims targeting companies. Our speakers were Partner Agnieszka Stefanowicz-Barańska and Counsel Anna Gulińska from Dentons, co-authors of the Commentary to the Polish Act on Private Enforcement.
